This document is a working draft for Marten's Realm. It is not legal advice. Have a Canadian privacy lawyer review it before you rely on it, especially if you sell into Quebec or change how you advertise.

1. Who we are

This Privacy Policy explains how Autana Consulting Inc. ("Autana," "we," "us") collects, uses, and discloses personal information when you visit or shop at Marten's Realm (the "Store"), including www.martensrealm.com and related checkout, email, and customer-service channels.

Marten's Realm is a store brand and cost centre of Autana. The Store is hosted by Shopify. Payments, shipping, advertising, and email tools are provided by other companies named below.

2. Scope

This policy applies to personal information we handle as the operator of the Store. Shopify also processes information as a service provider and, for some of its own features, as an independent organization. Shopify's consumer privacy information is at https://privacy.shopify.com/en.

If our Terms of Service and this policy conflict on privacy, this policy controls for collection, use, and disclosure of personal information.

3. Personal information we collect

Depending on how you use the Store, we may collect:

•       Identity and contact details: name, email, phone, billing and shipping address.

•       Account details: password and preferences, if you create an account.

•       Order and payment details: products viewed, cart contents, purchases, returns, payment method type, and transaction identifiers. Full card numbers are handled by the payment processor, not stored by us as a card file.

•       Communications: emails, chats, reviews, and support messages.

•       Device and usage data: IP address, browser and device type, pages and products viewed, referring URLs, and approximate location derived from IP.

•       Marketing identifiers: cookie IDs, advertising IDs, and hashed email or phone used to measure ads.

4. Where it comes from

•       You, when you browse, check out, join the email list, leave a review, or contact us.

•       Automatically, through cookies, pixels, and similar technologies on the Store and checkout.

•       Service providers acting for us (Shopify, payment, fulfillment, email, reviews, analytics, ads).

•       Advertising platforms, when they report that an ad led to a visit or purchase.

5. How we use it

We use personal information to:

•       Process orders, payments, shipping, returns, and customer service.

•       Operate and improve the Store, including remembering carts and preferences.

•       Detect fraud, abuse, and security incidents.

•       Send transactional messages about orders and accounts.

•       Send marketing email if you subscribe or as otherwise permitted by Canadian anti-spam law (CASL). You can unsubscribe in every marketing email.

•       Measure and deliver advertising on Meta (Facebook and Instagram), TikTok, Google, and similar networks, including showing you ads after you visit the Store.

•       Comply with law, including Canadian consumer-product and tax record-keeping, and respond to lawful requests.

6. Advertising, analytics, and email

To measure the Store and show Marten's Realm ads on other sites and apps, we use advertising and marketing platforms. With our current settings this includes:

•       Meta Platforms (Facebook and Instagram), including the Meta Pixel and Conversions API.

•       TikTok, including the TikTok Pixel and Events API.

•       Google (including Google Analytics 4 when connected).

•       Klaviyo for email and related on-site forms.

•       Yotpo for reviews.

These providers may receive device and usage data, products you view or add to cart, purchase value and currency, and identifiers such as email or phone number (often hashed) so they can match activity to an ad or email profile. Data-sharing level in Shopify is set to Maximum for Meta and TikTok, which includes conversion events sent from Shopify's servers as well as the browser.

Those companies process information under their own policies. You can limit some targeted ads in each platform's settings (for example Meta Off-Facebook activity, TikTok ad settings, Google ad settings) and through industry opt-outs where available. Unsubscribing from email does not by itself stop all advertising measurement.

7. Who we disclose it to

We disclose personal information only as needed to run the Store or as required by law, including to:

•       Shopify, and apps installed on the Store.

•       Payment processors and fraud tools.

•       Fulfillment and dropshipping partners (including Zendrop and CJ Dropshipping) and carriers.

•       Advertising and analytics platforms listed in section 6.

•       Email and review providers (Klaviyo, Yotpo).

•       Professional advisers and authorities when legally required.

•       A buyer of the business, under appropriate protections, if Autana sells or reorganizes Marten's Realm.

We do not sell your personal information for money. Some privacy laws treat targeted advertising as a "sale" or "share." Where those laws apply, you may have the right to opt out of that use as described in section 12.

8. Cookies and similar technologies

The Store uses cookies, pixels, and local storage to keep the site working (cart, session, checkout), to remember preferences, and to measure marketing. Advertising cookies may persist after you leave the Store. You can block or delete cookies in your browser; parts of checkout may not work if you block essential cookies.

9. Children's information

Marten's Realm sells toys intended to be purchased by adults (parents and gift-givers). The Store is not directed at children, and we do not knowingly collect personal information from children under the age of majority in their province or territory. We do not target ads at children.

If you believe a child has submitted personal information, contact us and we will delete it where required. We do not have actual knowledge that we sell or share personal information of individuals under 16 for targeted advertising.

10. Canada, Quebec, and other laws

We handle personal information in line with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial law. If you are in Quebec, Quebec's privacy legislation (including Law 25) may give you additional rights, including rights of access, correction, withdrawal of consent where it applies, and data portability in the circumstances the law provides.

Commercial electronic messages are sent in line with Canada's Anti-Spam Legislation (CASL). Marketing email requires consent except where CASL allows another basis. You can withdraw consent using the unsubscribe link.

If you are in the EEA, UK, or another region with extra rights, we will honour those rights where they apply to our processing.

11. Storage, transfers, and retention

The Store is hosted by Shopify. Personal information may be stored or processed in Canada, the United States, and other countries where our providers operate. Those countries may have different privacy laws than your home jurisdiction.

We keep information only as long as needed for the purposes above, including order history, tax and consumer-product records, dispute handling, and legal holds. Advertising logs are kept according to each platform's settings and our account configuration.

12. Your rights and choices

Subject to legal limits, you may request to:

•       Access the personal information we hold about you.

•       Correct inaccurate information.

•       Delete information we no longer need to keep.

•       Receive a copy in a portable format where the law requires it.

•       Withdraw consent for optional uses such as marketing email.

•       Opt out of targeted advertising where applicable law gives that right.

To make a request, email info@autanaconsulting.com or write to the address in section 1. We may need to verify it is you. You may use an authorized agent if you provide proof of authority. We will not penalize you for exercising these rights.

Shopify also lets you exercise certain rights for data it controls at https://privacy.shopify.com/en.

13. Security

We and our providers use administrative and technical measures appropriate to a small ecommerce store. No online transmission is perfectly secure. Do not send payment card numbers to us by unencrypted email.

14. Complaints

Contact us first using the details in section 1. You may also complain to the Office of the Privacy Commissioner of Canada (https://www.priv.gc.ca) or, if you are in Quebec, the Commission d'accès à l'information du Québec.

15. Changes

We may update this policy when our practices or the law change. The "Last updated" date will change, and we will post the new version on the Store. Material changes will be highlighted where the law requires notice.
